ELIGIBILITY REQUIREMENTS FOR EB-5 INVESTORS
An EB-5 investor must:
  1. Demonstrate the lawful source and path of investment funds.
  2. Have no criminal record and not be subject to grounds of inadmissibility to the United States.
  3. Not be subject to U.S. sanctions and have no affiliation with sanctioned individuals, banks, or jurisdictions.
  4. Not pose a threat to U.S. national security (including extremism, terrorism, or intelligence activities).
  5. Provide complete, truthful, and consistent information in all immigration filings.
The Fundamentals: What Every Prospective EB-5 Investor Should Know:

OBTAINING AN EB-5 VISA IN 5 STEPS

1. Engage an Immigration Attorney
You will be connected with leading business immigration experts to discuss your immigration strategy and to compile the documentation required to verify the lawful source of funds. Your attorney will review your documents, prepare the petition, and file it with the U.S. Citizenship and Immigration Services (USCIS).
2. Select a Project
With the assistance of a USCIS-approved Regional Center, you will be able to select a reliable investment project and complete the project subscription.
3. File the I-526E Petition
After the investor has selected a project, transferred the investment funds to the project’s escrow account, and provided their attorney with all supporting documentation, the attorney files Form I-526E with the U.S. Citizenship and Immigration Services (USCIS).
Following the filing of the petition, the investor must await its adjudication. During the petition review period, the investor may be eligible to file Adjustment of Status petition and remain in the United while awaiting an adjudication.
4. Receive Your Permanent Green Card
Before the expiration of the conditional residency period, your attorney will file the I-829 petition to remove conditions on residency status. Once the I-829 is approved, the LPR status conditions are removed.
5. Obtaining a Green Card
After approval of the petition, the attorney assists you during the consular processing stage, helps complete and submit Form DS-260 to the National Visa Center (NVC), and prepares you for the interview.
After receiving an immigrant visa and entering the United States, the investor is granted a conditional green card valid for 2 years. Upon expiration of this period, following the filing and approval of Form I-829, the conditions are removed, and the investor and eligible family members obtain permanent green cards.

Preparation and Submission of Initial Documents:
From as fast as 2 weeks to several months – your timing depends solely on the complexity of your case and how much time you take to collect the source of funds documents and provide them to your immigration attorney.
Adjudication of Your I-526E Petition:
6 to 18 months.
Issuance of the First Temporary (Conditional) Green Card:
6 to 12 months after your I-526E petition approval.
Filing I-829 Petition for a Permanent Green Card:
21-24 months after receiving the conditional green card.
Receiving the Permanent Green Card:
6 to 24 months after submitting the I-829 petition.
Investment Return ($800,000):
After the project’s EB-5 investment term matures (the current USCIS policy requires a minimum of a 2-year hold) and subject to the project performance, an investor is eligible to receive return of capital. . On average, EB-5 project investment periods range from 3 to 5 years. It is important to note that return of the investment cannot be guaranteed under the EB-5 program.
Filing for U.S. Citizenship:
5+ years after becoming a conditional LPR and the I-829 Approval must also be secured.
What Qualifies for an EB-5 Investment?
An eligible investment is an investment in a job-creating entity (usually through a subscription to an LLC or LP). Purchase of personal or commercial real estate does not qualify you under the EB-5 Program.
Are There Guarantees for Investment Return?
An EB-5 investment must carry an entrepreneurial risk; thereby prohibiting a guarantee of return of capital. Choosing a reliable Regional Center with established repayment record is a key factor in minimizing risks for your immigration and investment process. We work only with Regional Centers with extensive track record.
Can the Investment Be Insured?
No. Insurance contradicts with the “at-risk” EB-5 requirement.
When I move to the US, do I have to live where my investment is located?
No. There are no limitations. Investors can reside anywhere in the US.
Can a Third Party Invest on My Behalf?
Yes. A third party may act as a donor or lender of funds, subject to their ability to justify the source and path of funds.
Can I use a Loan to Finance My EB-5 Investment?
Yes, it is allowed, subject to loan parameters and compliance with the source of funds requirements.
